Fitness Waiver & Release of Liability

ASSUMPTION OF RISK, WAIVER OF LIABILITY, AND INDEMNITY AGREEMENT 1. PARTIES AND SCOPE This Assumption of Risk, Waiver of Liability, and Indemnity Agreement ("Agreement") is entered into by and between the undersigned participant ("Client" or "I") and Dominus Capital LLC, doing business as The Dominus Collective (hereinafter collectively referred to as "Releasees"). The scope of this Agreement broadly covers all participation in and use of the Releasees' services, including but not limited to: in-home personal training, fitness coaching, nutritional guidance, metabolic protocols, workout recommendations, supplement recommendations, and the use of any information, programs, or digital content provided through the Dominus app, website, or other online platforms. 2. ACKNOWLEDGEMENT OF INHERENT RISKS I acknowledge that my participation in rigorous physical activity, strength training, cardiovascular conditioning, and my execution of any workout recommendations or nutritional/supplement protocols involves inherent risks, dangers, and hazards. These risks include, but are not limited to, muscle strains, joint sprains, cardiovascular complications, adverse reactions to supplements, severe bodily injury, illness, property damage, and potentially death. I fully understand that these risks cannot be completely eliminated, regardless of the care taken to avoid injuries. I voluntarily assume all such risks, both known and unknown, even if arising from the negligence of the Releasees or others, and assume full responsibility for my participation and my use of the Dominus app. 3. MEDICAL CLEARANCE AND DISCLAIMER I confirm that I am in good health and physical condition and do not suffer from any known disability or condition that would prevent or limit my participation in these fitness programs. I acknowledge that the representatives of Dominus Capital LLC and The Dominus Collective are not medical professionals. Any information, workout recommendations, supplement recommendations, or nutritional guidelines provided in-person or digitally through the Dominus app are for informational and educational purposes only. They are not intended to diagnose, treat, cure, or prevent any medical condition, nor are they a substitute for the advice of a qualified healthcare provider. I agree that I have been strongly advised to consult with a physician prior to commencing any new exercise program, altering my diet, or taking any recommended supplements. 4. WAIVER AND RELEASE OF LIABILITY In consideration for being permitted to participate in the programs and utilize the services and digital applications offered by The Dominus Collective, I, on behalf of myself, my heirs, executors, administrators, and assigns, hereby unconditionally release, waive, discharge, and covenant not to sue Dominus Capital LLC, The Dominus Collective, and all their respective officers, directors, employees, members, and agents from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, adverse reaction, or injury, including death. This includes, without limitation, any injuries or damages sustained while participating in the programs, while on the premises where training is conducted, or resulting from the reliance on any information, workout recommendations, or supplement recommendations provided through the Dominus app or other channels, whether caused by the negligence of the Releasees or otherwise. 5. INDEMNIFICATION AND HOLD HARMLESS I agree to indemnify, defend, and hold harmless the Releasees from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney's fees, brought as a result of my involvement in the fitness programs, use of the Dominus app, or reliance on any recommendations provided by The Dominus Collective, and to reimburse them for any such expenses incurred. 6. GOVERNING LAW AND SEVERABILITY This Agreement shall be governed by and construed in accordance with the laws of the State of Florida. If any portion of this Agreement is held to be invalid or unenforceable, I agree that the remaining terms shall continue in full legal force and effect. 7. ACKNOWLEDGEMENT OF UNDERSTANDING I have read this Assumption of Risk, Waiver of Liability, and Indemnity Agreement, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am agreeing to this document freely and voluntarily, and intend by my signature or digital acceptance for this to be a complete and unconditional release of all liability to the greatest extent allowed by law.
